Arizona Asbestos Law Information

Use of the mineral asbestos in commercial and residential construction materials began in the early 1900's and continued until the 1970's. Its durability, insulation properties, and resistance to both corrosion and fire made it one of the most popular materials for more than 3,000 commercial products, including roofing, plumbing and wiring. Many plaster, floor tile, heating duct, and wall and ceiling insulation products also contained asbestos.

Significance

    Many workers in Arizona have been exposed to asbestos fibers, which pose a serious health risk when they are disturbed or damaged and become airborne. While some people may develop health problems from asbestos exposure, others may not. The minute size of the fibers makes them easy to inhale and allows them to enter various body tissues. Continued exposure may lead to the development lung cancer, mesothelioma and others diseases that may appear many years after initial exposure.

State Agency

    The Clean Air Act gives the U. S. Environmental Protection Agency (EPA) direct authority over implementing laws related to asbestos removal and the renovation or demolition of areas containing it. The EPA functions within its authority to assign these responsibilities to the states, but maintains oversight.

    In Arizona, the Arizona Department of Environmental Quality (ADEQ) is responsible for enforcing laws related to asbestos. ADEQ follows the same guidelines for asbestos as the Asbestos National Emission Standard for Hazardous Air Pollutants (NESHAP), a federal program to protect public health and safety.

Federal Regulations

    NESHAP regulations limit the use of asbestos and spell out the process for closing asbestos sites and for manufacturing products with asbestos-containing materials. The regulations also address renovation or demolition activities, asbestos removal, transport and disposal. Air cleaning devices and record-keeping also fall under this program.

Employers

    Arizona state employment statutes obligate employers to furnish employees with work environments free of hazards that might result in health problems or death. Entities have strict requirements for exposure limits and conducting exposure assessment. Companies must adhere to laws concerning medical monitoring, record keeping, regulated areas and hazard communication, as mandated by the federal Occupational Safety and Health Administration (OSHA).

Removal

    Arizona law for the removal of asbestos, or the demolition of buildings that contain asbestos, specifies the techniques to be used for removal. The company or property owner must give the NDEQ a written notification of the job before commencing work. Only licensed asbestos companies and workers may remove damaged or "friable" asbestos material. Workers must wear protective clothing, including boots, hood and goggles. They must also wear a specially approved respirator. The crew must be cordoned off from the surrounding space using approved techniques.

    Workers must wet down the asbestos-containing material and must remove the material in sections and place it in 6-mm a polyethylene bag encased in a second bag. The worker must seal the bag, mark it as "asbestos," and transport it to an approved location for disposal. Once the removal or demolition ends, the workers must clean up the work area. A licensed technician must test the work site and surrounding space for asbestos dust to ensure complete removal.
