How to File a Legal Document for Child Support

Child support is a monthly payment made by the noncustodial parent to the custodial parent to help cover the costs associated with raising a child. Child support is intended to help pay for food, water, clothing and shelter. Child support payments are made mandatory through a court order. If the parents of a child divorce, a child support order will be entered with the divorcee decree. If the parents are unmarried, however, the custodial parent for a child needs to file a petition with the court to obtain child support through a court order. This process is sometimes referred to as "applying for child support."

    Contact the nearest courthouse that hears probate matters and ask what steps you need to take to obtain a child support order. Although requirements vary by state, most states require a child support application or similar document be filled out by the custodial parent. These documents are available at the courthouse, though many courthouse websites make these forms available for download online.

    Complete the child support application and obtain any additional paperwork required. For example, some states require the custodial parent to provide a copy of his financial statement.

    Take the completed child support application and accompanying papers to the clerk at the courthouse to have them filed. The clerk's office will be clearly marked once you are inside the courthouse.

    Pay the appropriate filing fee and wait for the clerk to give you a court date. You will receive a letter in the mail confirming when you must appear before the judge to discuss child support. The noncustodial parent will receive a similar letter.

    Prepare for court. Gathering all supporting documentation that demonstrates your financial situation. For example, collect pay stubs, make copies of your utility bills and obtain receipts for any child care costs. At the end of the hearing, the judge will enter a support order. Generally, you can expect to see your first child support check the following month, though the turnaround time varies by state and courthouse.
