How to Settle a Civil Judgment
Settling the judgment levied against you in civil court is the final step in the litigation process. Settling a judgment is important, as failure to do so can result in court sanctions, a negative mark on your credit report or garnishment of your wages. Before you begin you should start by contacting the attorney who represented you in your civil lawsuit. Your attorney may have a strategy as to how you should handle settlement.
Instructions
- 1
Obtain a copy of the judge's final order in your case or the agreed upon terms of your settlement contract. The order or settlement agreement should include information about what you owe to the other party, so you will need this information before you can proceed. The court's opinion can be obtained at your local department of court records.
2Determine whether you have to pay interest on the amount due for the time between the court's judgment and your first payment. Delay damages can be added to an award in some circumstances; and if the other party spends funds trying to collect on an old judgment, you may be forced to pay those fees as well.
3If required in your jurisdiction, file an order of civil judgment by contacting your court administration office. Your attorney can determine what other paperwork may be necessary.
4Pay all monies owed to the other party. In some instances you may be permitted to pay the money in installments. Be sure to comply with any specific payment terms. For example, some settlements require that you make payment by cashier's check only.
5Contact the other party and obtain a satisfaction of judgment statement; file it with the court. After filing your satisfaction of judgment, your settlement will be complete.
