The Average Salary for a Patent Attorney
Patent lawyers are specialized attorneys who prepare, file and prosecute patent applications. Comparing the Bureau of Labor Statistics (BLS) salary data for lawyers in general with that of Pay Scale's data for patent lawyers, patent lawyers make slightly less on average than lawyers in other specialties. However, patent law is a growing field and experienced lawyers make considerably more than the average.
Average
BLS states that the average salary for a lawyer in the U.S. is $110,000. According to Pay Scale, the average salary for a patent attorney is around $100,000 a year, though nearly every lawyer receives generous benefits. Individual salaries vary widely by experience and standing in a given firm.
Novices
According to Pay Scale, a website that tracks salary ranges, patent attorneys start at around $60,000 a year, and many see modest raises after several years in the job. After five years of experience, however, the average jumps to $80,000, suggesting good promotion prospects.
Partners and Experienced Attorneys
Patent attorneys with over 10 years of experience net an average salary of slightly more than $100,000, though Patent Bar Study reports considerably higher averages --- $180,000 --- and cites the American Intellectual Property Law Association (AIPLA). All sources agree that partners at patent law firms make a considerable amount, averaging $300,000 in AIPLA's sample and $280,000 among those surveyed by the Patent Bar Study.
Job Prospects
According to The New York Times and Foreign Policy editor Moises Naim, the number of patent lawsuits will continue to grow in the foreseeable future. Not only are the number of patents in use growing, but the number of lawsuits appears to be exploding due to rising piracy and counterfeiting. As long as these trends continue, patent lawyers can expect to see their salaries rise.
